2. Purpose

These general terms and conditions of sale (hereinafter referred to as the "General Terms and Conditions of Sale") govern all sales concluded between Lambert Boxing and any non-professional customer on the website www.striking-paris15.com. The General Terms and Conditions of Sale in force on the date of the order prevail over any contrary terms or stipulations, and they cancel and replace any previous general terms and conditions of sale that may have governed the prior relations between the Parties. Subscribing to any order by the Customer implies acceptance of these General Terms and Conditions of Sale. The Customer declares having read and accepted these General Terms and Conditions of Sale without reservation in their entirety. These General Terms and Conditions of Sale may be subject to subsequent modifications, and the version applicable to the Customer's purchase is the one in force on the site at the time of the order – said version is attached to the email sent to the Customer by Lambert Boxing to acknowledge receipt of the order and payment –, and any other version will consequently be unenforceable against Lambert Boxing, which the Customer expressly acknowledges.

The invalidity of any clause of the General Terms and Conditions of Sale does not entail the invalidity of the General Terms and Conditions of Sale or the other clauses, which will retain all their force and scope unless the Customer demonstrates that the invalid provision was essential and determining without which they would not have contracted. The temporary non-enforcement of one or more clauses of the General Terms and Conditions of Sale by Lambert Boxing cannot be interpreted as a waiver of their rights under this clause or any other clause of these General Terms and Conditions of Sale, which continue to produce effects unless expressly and in writing waived by Lambert Boxing. In this respect, it is specified that Lambert Boxing's failure to invoke a breach by the Customer of any of their obligations under these General Terms and Conditions of Sale shall not be interpreted as a waiver to invoke said breach at a later date.

3. Orders

Orders are placed online at www.striking-paris15.com.

The Customer selects either a single class or a trial session.
The Customer reserves a class online (the first class in the case of a trial session).
The Customer provides personal information.
The Customer reads and accepts the General Terms and Conditions of Sale.
The Customer confirms the order by clicking the [Proceed to Payment] button.
The Customer enters their credit card details for payment.

4. Single Classes

The Customer purchases a single class through the purchase interface on the site, which they must reserve and pay for online. This does not grant access to the Club outside the purchased class.

The Customer may only access the club to attend the class they purchased online. They are allowed to enter the club half an hour before the class starts and may stay for half an hour after the class, notably to use the locker room. However, the Customer is not allowed to train alone in any sports area.

The Customer will not be refunded for a class reservation canceled less than 6 hours before the class. A Customer cannot participate in a reserved class if they arrive after it has started, and the Customer will not be refunded.

5. Private Class Packages

The Customer can purchase private class packages. These packages include 10 sessions, valid for 12 months.

When ordering a private class session on the website www.striking-paris15.com, the Customer may use their session package until all sessions are used up. Afterward, they must either purchase a new session package or pay for sessions individually.

The session packages are payable directly on the website www.striking-paris15.com and must be paid for before booking a private class. Packages are non-refundable and non-transferable. The Customer agrees not to transfer ownership of their package to any other person.

6. Subscriptions

Striking offers several types of subscriptions:

A subscription at €150/month for a 12-month commitment.
A subscription at €200/month for a 1-month commitment (available only once).
A subscription at €100/month for a 12-month commitment, providing access to 8 sessions per month, i.e., 2 sessions per week.
A subscription at €130/month for a 12-month commitment, providing access to 12 sessions per month, i.e., 3 sessions per week.
A subscription at €80/month for a 12-month commitment, reserved for teenagers. Lambert Boxing reserves the right to request an ID to verify the client's age.
An annual subscription at €1,600, paid in a single payment.

Subscriptions are not automatically renewed at the end of the commitment period. Monthly subscriptions cannot be canceled during the year.

Subscription plans are paid monthly, with the first payment made by credit card and subsequent payments by direct debit. To access the class reservation schedules in the Member Area, the Customer must authorize SEPA direct debit through the payment provider Stripe, which fully manages and operates the payments.

7. Services Included in the Subscription

Lambert Boxing offers the Customer the opportunity to practice a sport, including boxing, kickboxing, muay thai, or MMA, within its club. In the Member Area, the Customer can view the club’s opening and closing hours, consult the class schedules, or book a private class. The Customer can access the Member Area online on the website www.striking-paris15.com using their email address and a personal password.

The club is generally open:

Monday to Friday from 8:00 AM to 9:00 PM
Saturday from 9:30 AM to 6:00 PM

The Customer can participate in group classes with limited participants, led by fitness instructors. Group classes last one hour.

The club's opening hours, class schedules, and closure days, which the Customer acknowledges having been informed of before subscribing, are available in the clubs and on the Member Area. Lambert Boxing reserves the right to modify them to meet customer needs.

Lambert Boxing also reserves the right to close the club and temporarily deny the Customer access:

On an exceptional basis, for maintenance, renovation, or commercial privatization,
On public holidays (New Year’s Day, Easter Monday, Labor Day, May 8, Ascension Thursday, Whit Monday, Bastille Day, Assumption, All Saints’ Day, Armistice Day, Christmas),
For 15 business days during the summer period of July-August.

Any closure will be communicated to the Customer through the schedule available in the clubs and on the Member Area. No closure will entitle the Customer to a refund, even partial.

The Customer may also access the club during its opening hours but is not authorized to use the sports areas without supervision from a Striking fitness instructor. Striking reserves the right to deny access to a Customer who is not enrolled in a group class to comply with the regulatory limits (fire safety) on the number of people allowed in the club.

8. Customer Obligations

The Customer must be of legal age to purchase a single class or subscribe to a membership.

The Customer cannot transfer, free of charge or for a fee, occasionally or permanently, the membership subscribed to under this contract. Lambert Boxing will deny access to the club to anyone attempting to enter the club without holding the membership or reservation for the class.

The Customer declares having had a medical examination certifying their fitness to practice sports, including boxing, kickboxing, muay thai, or MMA. The Customer agrees to have the medical certificate available for submission upon request from Striking. Therefore, the Customer releases Striking from any liability in case of an accident related to their health condition. The Customer agrees to communicate any relevant health information to the instructor leading their class. The Customer agrees to take all necessary precautions to practice safely, to preserve their health and that of others, and to follow the recommendations and instructions from Lambert Boxing. Finally, the Customer accepts the inherent risks of practicing boxing, kickboxing, muay thai, or MMA, especially when practiced with opposition and involving a risk of injury.

The Customer agrees to follow any instructions from Lambert Boxing staff or instructors to practice boxing, kickboxing, muay thai, or MMA safely for themselves and others. The Customer declares having read the Internal Rules, accessible on the website www.striking-paris15.com. The Customer agrees to strictly comply with the Internal Rules and the hygiene and safety regulations, which may be reminded by Lambert Boxing. In case of non-compliance with the Internal Rules, Lambert Boxing reserves the right to take all necessary measures to protect the interests of all its Customers, including temporary or permanent exclusion from the Club.

For collective security, the Customer’s personal belongings are not allowed in the class areas. Sport bags and other personal belongings must be stored in the provided areas at the entrance of the group class room. The Customer agrees to hand in their valuables to the reception desk and cannot hold Lambert Boxing responsible for any theft or loss of items not entrusted to them.

9. Right of Withdrawal

The Customer has a 14-day withdrawal period from the date of their order on the website www.striking-paris15.com to notify Lambert Boxing of their intention to withdraw, without reason or penalty, by email to bertrand.lambert94@gmail.com.

10. Duration

The monthly subscription takes effect from the Customer's order or from another date specified by them and confirmed in writing to the Lambert Boxing team (bertrand.lambert94@gmail.com) at the time of subscription, for a duration of 1, 6, or 12 months from the effective date of the subscription.

11. Prices

The applicable prices are inclusive of all taxes, expressed in euros, and are those in effect on the day of the subscription. Lambert Boxing reserves the right to modify its rates. The new rates will apply to subscriptions taken out after the price change, once the change has been communicated through the usual channels to inform the Customer.

12. Termination Conditions

Any termination request must be made by email to bertrand.lambert94@gmail.com. No verbal request to the Lambert Boxing team present at a club will be taken into account.

Except in exceptional circumstances (proof of relocation, injury, or physical incapacity), subscriptions (1, 6, and 12 months), as well as private class packages, are non-cancelable.

Lambert Boxing reserves the right to terminate the subscription automatically, without notice or prior formal notice, in case of violation of applicable laws, particularly criminal laws or those aimed at protecting third-party rights. In the event of a serious and/or repeated violation of these terms and conditions and/or the club's internal rules regarding hygiene or safety, Lambert Boxing reserves the right to terminate the subscription and may seek compensation for any damages suffered by Lambert Boxing.

Lambert Boxing also reserves the right to terminate any subscription at any time and without reason by refunding the amounts already paid by the Customer on a prorated basis for the remaining period. Upon notification of the termination of their subscription, the Customer will be permanently denied access to the facility.

13. Image Rights

Taking visuals (photos, videos) within Lambert Boxing is strictly prohibited without the express consent of Lambert Boxing. Lambert Boxing reserves the right to take any action to assert its rights in case of public dissemination of images taken within the club.

Lambert Boxing may produce visuals (photos, videos) in which the Customer may appear. The Customer expressly authorizes Lambert Boxing to use said visuals to promote the club.

The Customer may object to the use of said visuals by indicating so in writing to bertrand.lambert94@gmail.com or SARL Lambert Boxing – 36 Rue de l'Abbé Groult – 75015 Paris.

14. Insurance

Striking is insured with the MAF insurance company, under contract number MME003, for damages directly related to its activities and engaging its Civil Liability.

15. Data Protection

The data concerning the Customer is intended for the management of the Customer’s subscription by Lambert Boxing. In accordance with the modified law of January 6, 1978, "Data Processing, Files, and Freedoms," the Customer consents to Lambert Boxing sending them offers and updates about its services via email, SMS, or phone. The Customer can oppose this by sending an email to bertrand.lambert94@gmail.com.

The Customer has the right to access, rectify, and delete information concerning them, which they may exercise at any time by contacting SARL Lambert Boxing – 36 Rue de l'Abbé Groult – 75015 Paris.
